A dissertação em questão tem por objetivo examinar a relação entre o Estado Constitucional, os Direitos Fundamentais e as políticas públicas, em especial, a de acessibilidade. O estudo se faz sob o prisma das Leis do Orçamento (Plano Plurianual ? PPA, Lei de Diretrizes Orçamentárias ? LDO e Lei Orçamentária Anual - LOA) como instrumento técnico-financeiro de controle para a efetivação dessa política pública. Discorre, portanto, sobre a pessoa com deficiência, seu conceito, a história do seu tratamento social, bem como a sua situação nas Constituições brasileiras, com destaque para a Constituição Federal de 1988. Com esse fito, investiga o direito de acessibilidade da pessoa com deficiência como Direito Fundamental, o que, por propiciar a fruição de muitos outros, ganha destaque e exige a aplicação de políticas públicas pelos Poderes Públicos no município, ente federado onde as pessoas vivem e desenvolvem suas atividades. A metodologia utilizada na elaboração da análise constitui-se em estudo descritivo-analítico através de pesquisa bibliográfica, de natureza qualitativa e, quanto aos fins, exploratória. Conclui-se que as Leis do Orçamento agem como instrumento técnico-financeiro de controle para efetivação de políticas públicas de acessibilidade, propiciam a concretização desse Direito Fundamental e respeitam a própria Constituição Federal, base do Estado Constitucional.

The paper in question aims to examine the relationship between the Constitutional State, Fundamental Rights and public policies, in particular, the accessibility. The study is done through the prism of the Budget Law (Multi-Year Plan - PPA, the Budget Guidelines Law - LDO and the Annual Budget Law - LOA) as a technical instrument of financial control for the fulfillment of this policy. Discusses, therefore, about the person with disabilities, their concept, the history of their social treatment, as well as its situation in the Brazilian Constitutions, especially the Federal Constitution of 1988. With this aim, the right to investigate accessibility of disabled people as a fundamental right, which provide for the enjoyment of many others, stands out and demands the implementation of public policies by the government in the county, federal entity where people live and develop their activities. The methodology used in preparing the analysis is on descriptive and analytical study through literature review, qualitative and, for purposes of exploration. At the end, we intend to demonstrate that the Laws of the Budget act as a technical instrument for effective financial control of public policies on accessibility, and foster the realization of fundamental rights, respects the Federal Constitution itself, the basis of the Constitutional State.
