O ensaio acadêmico examina a tendência ativista do Judiciário Eleitoral, fenômeno
por meio do qual se defende uma atuação mais efetiva do Juiz Eleitoral para que se
possa garantir a vontade desimpedida do eleitor e dessa maneira realizar a verdade
material das urnas. Observa-se os riscos do ativismo judicial, vez que este comportamento, notadamente no âmbito da Justiça Eleitoral, exorbita os limites de
atribuições desta jurisdição. Inicialmente, analisam-se elementos da teoria da democracia e do constitucionalismo como necessários suportes para reflexão sobre o
papel do Poder Judiciário no Estado Democrático de Direito, chegando-se ao estudo
de hodiernas concepções de modelos de democracia nos quais se defendem diferentes formas de atuação do Judiciário. Posteriormente, descreve-se as formas clássicas de jurisdição constitucional e, ainda, o tipo híbrido adotado pelo ordenamento jurídico brasileiro para então se entender em que consiste o ativismo judicial e quais ameaças este comportamento traz ao equilíbrio do Estado de Direito. Pesquisa-se, também, as principais características e funções da justiça especializada eleitoral, especialmente a sua peculiar função regulamentar, concluindo-se que a utilização desta competência pode servir de expediente para propagação do ativismo judicial, tal qual se observa na Resolução 22.610-2007 do TSE que trata sobre o processo de perda e justificação de mandato político por infidelidade partidária. Analisa-se, igualmente, a repercussão jurisprudencial da tese da moralidade como condição implícita de elegibilidade, defendida por vários juízes e Tribunais Regionais Eleitorais, que evidencia o ativismo judicial não só nos Tribunais Superiores. D dissertação provoca reflexo quanto à tendência do ativismo judicial se tornar um paradigma moderno do estado de exceção. Conclui-se, por fim, que a par da necessária atuação efetiva da Justiça Eleitoral, não pode esta agir além dos seus limites de atribuições determinadas no Estado Democrático de Direito, nem mesmo se conferir o papel de protagonista do processo eleitoral, pois esta função cabe ao eleitor.

The academic essay examines the trend of activist Electoral Judiciary, a phenomenon by which defends a more effective performance of the Election Judge as to ensure the unfettered will of the voter and I will make the material faith to the ballot. We note the risks of judicial activism, since this behavior, especially under the Electoral Court, exceeds the limits of responsibilities of this jurisdiction. Initially, we
examine elements of the theory of democracy and constitutionalism as necessary supports for reflection on the role of the judiciary in a democratic state of law came to the study of present-day conceptions of democracy models in which they advocate different ways of acting the Judiciary. Subsequently, We describe the classic forms of constitutional jurisdiction, and also the hybrid type adopted by the Brazilian legal
system and then to understand what constitutes judicial activism and what threats this behavior brings into balance the rule of law. We also research the main features and functions of the justice system for elections, particularly its unique regulatory function, concluding that the use of this power can serve as a pretext for the spread
of judicial activism, as we noted in the resolution 22.610-2007 that the TSE is about
the process of loss and justification for partisan political mandate for infidelity. We
analyze also the effect of jurisprudential theory of morality as an implied condition of
eligibility, supported by several judges and the Regional Electoral Courts, which
highlights the judicial activism not only in the Superior Courts. It reflects on the trend of judicial activism to become a modern paradigm of the state of exception. We
conclude, eventually, that together with the necessary activeness of Elections, this
can not act beyond their limits of competence, even if given the core role of the electoral process, as this function belongs to the voter.
