A evolução do conceito de família, associada à dignidade da pessoa humana e aos direitos fundamentais à igualdade e à liberdade, possibilita o reconhecimento das uniões homossexuais como espécie de entidade familiar. As inúmeras transformações econômico-sociais acontecidas nos últimos séculos modificaram o conceito de família, passando esta a ser compreendida como um grupo social calcado no afeto e que se destina a assegurar o desenvolvimento pessoal de seus membros. A Constituição Fedral de 1988, seguindo os passos das mudanças sociais ocorridas, ampliou a âmbito de proteção jurídica conferida à família: por consequência, elegeu o afeto como fator importante para a sua formação. Sob essa perspectiva, destina-se o presente trabalho a demonstrar que a união afetiva entre duas pessoas do mesmo sexo, realidade social posta à margem do Direito, insere-se no âmbito das relações familiares, sob pena de conferir interpretação contrária aos direitos fundamentais dispostos na Constituição Federal. The evolution of family concept linked to human dignity and fundamental rights associated to
equality and freedom allows the recognition of homosexual unions as a sort of familiar entity.
The many economic and social changes which occured in the past centuries modified the
family concept and it began to be understood as a social group shaped in affection and
intended to ensure personal development of its members. The Brazilian Federal Constitution
of 1988, following the steps of social changes that occured back that time, increased the scope
of legal protection given to the family and, therefore, chose the affection as an important
factor for its arrangement. From this perspective, the present work is destinated to prove by
reasoning that homosexual union, a social reality that lays aside the law, inserts itself in the
extent of family relationships, under the penalty of giving contrary interpretation to
fundamental rights outlined in the Federal Constitution. Ver menos
