O presente estudo tem por objetivo demonstrar as linhas gerais da evolução histórica da Constituição frente aos poderes do Estado, tal como configurada na práxis jurídica e, de modo especial, na atividade do Judiciário. A Teoria Geral do Estado do século XIX, herdeira da concepção clássica de separação de poderes de Montesquieu, não possibilitava mais uma visão consistente, pela qual o Judiciário pudesse efetivamente controlar os demais poderes. Com o declínio do Estado liberal de Direito e o surgimento do Estado prestacional - intitulado Estado Social de Direito ? foi aberto o caminho para uma teoria material da Constituição, elaborando-se mecanismos para vincular o Legislativo segundo os fins constitucionais, reforçando-se assim os poderes judiciais de controle da constitucionalidade. Este modelo foi também adotado pelas constituições brasileiras do século XX, de modo especial pela Constituição de 1988, caracterizada como constituição-garantia e constituição-programa. Analisa-se, por fim, a crise do modelo de constituição dirigente pelo ângulo das reformas pelas quais tem passado o Judiciário.

The present study it has for objective to demonstrate the general lines of the historical evolution of the Constitution and the State, such as configured in the practical legal, and in special way in the activity of the Judiciary one. The General Theory of the State of century XIX, heiress of the classic conception of separation of powers of Montesquieu, did not make possible, still, a consistent constitutional theory, for that the Judiciary one could not, the severity, to control none of the too much powers. With the decline of the liberal State of Right and the sprouting of the prestacional State - intitled Social of Right - it was made possible construction of a material theory of the Constitution, being elaborated mechanisms to tie Legislative ends the according to constitutional, as well as the reinforcement of powers judicial in the control of the constitutionality of the rules of law. This model also was adopted by the Brazilian constitutions of century XX, special way for the Constitution of 1988, characterized as constitution-guarantee and at the same time, a constitution-program. It is in this platform that if it aims at to demonstrate as the crisis of the controller will have legal repercussion in the reforms of the Judiciary one.
