O Tribunal Popular do Júri foi introduzido no ordenamento jurídico nacional antes mesmo da Constituição Imperial de 1924. Inicialmente, tinha competência para julgar os crimes de imprensa. Ao logo dos anos, essa competência foi se alterando, algumas vezes foi ampliada e outras vezes encurtada. Atualmente, conforme expressa determinação da Constituição Federal de 1988, lhe comete julgar os crimes dolosos contra a vida, tanto na modalidade tentada como na consumada. Além dessa competência, goza a instituição dos seguintes princípios/garantias, todos igualmente previstos de forma expressa na Carta Política: a plenitude de defesa, a soberania dos veredictos e o sigilo das votações. Na presente dissertação, tenta-se demonstrar que essas garantias, esses princípios não vêm sendo respeitados na sua inteireza. Propõe-se, portanto, a dissertação, a analisar cada um dos princípios/garantias conferidos ao Júri, e a forma como eles vêm sendo desrespeitados na prática. Com isso, registra-se que o instituto corre o sério risco de, em razão do sucessivo desacato às suas molas mestras, perder sua essência, sua razão de existir, tornando-se, eventualmente, num tribunal caricato. Sugere-se, no decorrer da dissertação, algumas soluções para as mais diversas questões levantadas.

The Popular Court of the Jury was introduced in the National Legal System before
the Imperial Constitution of 1924. Initially, it had the competence to judge the crimes
of the press. Along the years, that competence was altered, sometimes extended

the Imperial Constitution of 1924. Initially, it had the competence to judge the crimes
of the press. Along the years, that competence was altered, sometimes extended
and other times shortened. At present, according to the express determination of the
Federal Constitution of 1988, it judges the premeditated crimes against life, both in
the tempted and finalized modalities. Besides that competence, it holds the following
principles/guarantees, all equally predicted in the Constitution: the plenitude of
defense, the sovereignty of the verdicts and the secrecy of the voting. In the present
dissertation, I show that these guarantees and principles are not entirely respected. I
analyze each one of the principles/guarantees conferred to the Jury, and the manner
in which they have been disregarded in practice. With that, I register that the institute
runs the risk of losing its essence due to the successive disrespect to its driving
forces and of becoming a cartoon court. Throughout this dissertation I suggest some
answers for the most diverse questions raised. Ver menos
