A presente dissertação tem como objetivo responder ao seguinte problema de pesquisa: É possível conciliar a voluntariedade inerente à Justiça Restaurativa com as condições impostas nos Acordos de Não Persecução Penal? Para tanto, será apresentado o regramento do ANPP estabelecido pela Lei nº 13.964/2019; o conceito e os princípios da Justiça Restaurativa, além de uma análise sobre a possibilidade de se harmonizar a voluntariedade intrínseca à Justiça Restaurativa com as condições, de certa forma impositivas, do ANPP, com o intuito de fortalecer e aumentar a eficácia da Justiça Criminal. Para a construção da pesquisa, a metodologia utilizada foi a investigação do tipo documental bibliográfica, com pesquisa pura de abordagem qualitativa, descritiva e exploratória quanto aos objetivos. Como resultado, constata-se que a adoção de práticas restaurativas no ANPP pressupõe equilíbrio na condução, respeitando a autonomia dos envolvidos e assegurando que sua participação se dê de forma verdadeiramente livre e consciente. Contudo, para sua efetividade, é essencial a adaptação da legislação regente dos institutos, investir na capacitação de profissionais, na criação de estruturas adequadas e na difusão da cultura restaurativa entre operadores do Direito. Relevante, por derradeiro, citar a necessidade de garantir a voluntariedade dos envolvidos, sem que o procedimento restaurativo seja percebido como uma condição obrigatória para obter os benefícios do ANPP.

This dissertation aims to answer the following research problem: Is it possible to reconcile the voluntariness inherent to Restorative Justice with the conditions imposed in Non-Prosecution Agreements? To this end, the ANPP rules established by Law No. 13,964/2019 will be presented; the concept and principles of Restorative Justice, in addition to an analysis of the possibility of harmonizing the voluntariness intrinsic to Restorative Justice with the somewhat imposing conditions of the ANPP, with the aim of strengthening and increasing the effectiveness of Criminal Justice. To construct the research, the methodology used was bibliographic documentary research, with pure research of a qualitative, descriptive and exploratory approach regarding the objectives. As a result, it is found that the adoption of restorative practices in the ANPP presupposes balance in the conduct, respecting the autonomy of those involved and ensuring that their participation is truly free and conscious. However, for its effectiveness, it is essential to adapt the legislation governing the institutes, invest in the training of professionals, in the creation of adequate structures and in the dissemination of the restorative culture among legal professionals. Finally, it is important to mention the need to guarantee the voluntariness of those involved, without the restorative procedure being perceived as a mandatory condition to obtain the benefits of the ANPP.
