O presente estudo propõe-se apresentar a mulher indígena cearense e os direitos que a circundam, suas lutas e a situação precária em que vivem. Diante de tantas demandas dentro e fora de suas aldeias, a mulher indígena nordestina busca um reconhecimento pautado no Princípio da Dignidade Humana, com o intuito de satisfazer necessidades básicas negligenciadas pela sociedade e pelo Estado, como saúde; educação; segurança; reconhecimento social; e respeito às culturas, religiões e demarcação de seus territórios. Analisa-se, ainda, os direitos constitucional e internacionalmente reconhecidos e a sua falta de implementação, em que se constatou o descaso das políticas públicas locais. Parte-se, desse modo, do conhecimento dos direitos dos povos indígenas para se fazer enxergar a luta feminina étnica e multicultural e seus desejos de igualdade em suas comunidades e perante a coletividade, a fim de reconhecer suas capacidades e identidade. Examina-se, ainda, a ligação da proteção dos direitos indígenas com o Novo Constitucionalismo Latino-Americano e a Decolonialidade advinda desse novo paradigma epistemológico, que surgiu por meio de lutas e reivindicações das comunidades locais com o propósito de eliminar os padrões impostos por anos pela colonização eurocêntrica assimilatória, a qual sufocou culturas, políticas e direitos locais. Busca-se, também, verificar a situação da demarcação das terras indígenas no Estado do Ceará, observando-se o uso de seus territórios e o impacto direto na vulnerabilidade e vida dessas mulheres. A metodologia envolve pesquisa interdisciplinar, com orientação epistemológica na teoria crítica, a congregar teoria e práxis na articulação do Direito Constitucional, Ambiental e Internacional, com análise documental e revisão bibliográfica, diante do estudo dos direitos dos povos indígenas e da mulher indígena no Estado do Ceará. Pautou-se ainda na base teórica do Constitucionalismo Latino-Americano e Decolonialidade, que ultrapassam o olhar tradicional anti plural, visto que almeja uma caracterização multiétnica dos direitos, além de investigar as dificuldades vividas por elas e as possíveis soluções de melhoria de vida diante da premência de satisfação de suas carências.

The present study proposes to present the indigenous woman from Ceará and the rights that surround her, her struggles, and the precarious situation in which she lives. Faced with so many demands inside and outside their villages, indigenous women from the Northeast seek recognition based on the Principle of Human Dignity, with the aim of satisfying basic needs neglected by society and the State, such as health, education, security, social recognition, respect to cultures, religions, and the demarcation of their territories. It also analyzes the constitutional and internationally recognized rights and the lack of implementation, where the neglect of local public policies is observed. It starts, therefore, from the knowledge of the rights of indigenous peoples to make visible the ethnic and multicultural female struggle and their desires for equality in their communities and before the community, to recognize their capabilities and identity. It also analyzes the link between the protection of indigenous rights and the New Latin American Constitutionalism and Decoloniality, arising from this new epistemological paradigm, which emerged through the struggles and claims of local communities with the purpose of eliminating the standards imposed for years by the assimilatory Eurocentric colonization that stifled local cultures, politics, and rights. It also seeks to verify the situation of the demarcation of indigenous lands in the State of Ceará, observing the use of their territories that has directly impacted on the vulnerability of these women's lives. The methodology involves interdisciplinary research, with an epistemological orientation in critical theory, to bring together theory and practice in the articulation of Constitutional, Environmental and International Law with document analysis and bibliographical review, in view of the study of the rights of indigenous peoples and indigenous women in the State of Ceará, in addition to the theoretical basis of Latin American Constitutionalism and Decoloniality, which go beyond the traditional anti-plural view towards a multiethnic characterization of rights, in addition to investigating the difficulties experienced by them and possible solutions to improve their lives in the face of the urgency of satisfaction of its shortcomings.
