Este estudo analisa o fenômeno das migrações internacionais com ênfase nas migrações marítimas. O objetivo da pesquisa é analisar as regulamentações internacionais dos migrantes por mar, especialmente, as normas de Direito Internacional do Mar que repercutem na proteção dos migrantes por mar, demonstrando a interseção do Direito Internacional do Mar e do Direito Internacional dos Refugiados. Para tanto, é realizado um estudo dos diversos espaços marítimos em que os Estados exercem jurisdição, visto que a perspectiva da jurisdição conferida aos Estados varia em cada zona marítima, sendo, portanto, importante verificar a repercussão dos direitos de soberania estatal, nos diferentes espaços marítimos, na proteção conferida aos refugiados, como também, nos deveres dos Estados de prestar assistência e socorro no mar. Considerando que os Estados costeiros se utilizam de estratégias para impedir o ingresso dos migrantes aos seus territórios, com a finalidade de obstar o requerimento de refúgio, a pesquisa tem ainda o intento de investigar se é legítima a solicitação de refúgio pelos migrantes que o tem o mar como fronteira e se os Estados, em contrapartida, têm a obrigação de possibilitar o pedido de refúgio, ainda que em alto-mar. Apura-se, também, a responsabilização dos Estados que descumprem a norma basilar de proteção internacional dos refugiados, o princípio do non-refoulement, devolvendo os refugiados aos seus Estados de origem ou abandonando-os à deriva no mar, sob o argumento da defesa da soberania estatal. Concluiu-se que há uma confluência do Direito Internacional do Mar e do Direito Internacional dos Refugiados, porém, as normas de ambos os ramos de Direito Internacional são insuficientes para solucionar tantas controvérsias, sendo, necessária uma revisão do sistema de proteção contemporâneo, visando preencher as lacunas para dar maior efetividade aos Direitos Humanos. Utilizou-se como metodologia os instrumentos normativos internacionais, regionais e nacionais, doutrina, artigos de autores renomados, nas temáticas acima delineadas.

This study analyzes the phenomenon of international migrations with emphasis on maritime migrations. The objective of the research is to analyze the international regulations of migrants by sea, especially the norms of International Law of the Sea that affect the protection of migrants by sea, demonstrating the intersection of International Law of the Sea and International Refugee Law. To this purpose, a study is carried out of the various maritime spaces in which States exercise jurisdiction, since the perspective of jurisdiction conferred on States varies in each maritime area, being, therefore, important to verify the repercussion of state sovereignty rights, in the different maritime spaces, in the protection granted to refugees, as well as in the duties of States to provide assistance and relief at sea. Considering that coastal States use strategies to prevent migrants from entering their territories, in order to prevent the request for refuge, the research also intends to investigate whether the request for refuge by migrants who have the sea as their legitimate frontier and whether the States, on the other hand, have the obligation to make the request for refuge possible, even on the high seas. It also determines the responsibility of States that fail to comply with the basic rule of international protection of refugees, the principle of non-refoulement, returning refugees to their States of origin or abandoning them adrift at sea, under the argument of defense of state sovereignty. It has been found that there is a confluence of the International Law of the Sea and the International Law of Refugees, however, the norms of both branches of International Law are insufficient to resolve many controversies, requiring a review of the contemporary protection system, in order to fill gaps to give greater effectiveness to Human Rights. The methodology used was international, regional and national normative instruments, doctrine and articles by renowned authors, in the themes outlined above.
