A presente dissertação, inserida no campo do Direito e tecnologia, estuda a tecnologia de registro distribuído (DLT) e suas aplicações como o blockchain e os smart contracts no âmbito da tributação indireta no Brasil. Busca-se responder como a tecnologia de registro distribuído se encaixa na sistemática da tributação indireta no Brasil. Na primeira seção, indaga-se a respeito das características da tributação indireta e sua influência no ambiente fiscal do país. Na segunda, pergunta-se sobre a tecnologia de registro distribuído e suas aplicações como o blockchain e os smart contracts. Na terceira seção, questiona-se a respeito dos cenários jurídicos, benefícios e riscos da aplicação da tecnologia no âmbito da tributação indireta. A pesquisa pode ser considerada aplicada, uma vez que se pretende oferecer alternativa tecnológica às pretendidas reformas legislativas e constitucionais na área tributária. Para tanto, efetua-se, no primeiro capítulo, um estudo descritivo e crítico a respeito da tributação indireta brasileira, abordando questões peculiares da organização política do país, características dos tributos indiretos, seu papel na arrecadação e alguns dos aspectos que lhes conferem elevada complexidade. No capítulo seguinte, debruça-se sobre a base tecnológica da DLT, a natureza desta tecnologia e suas aplicações mais conhecidas, bem como se introduz a noção de ¿lei como código¿, que representa a transformação da lei em linguagem natural para código computacional. Por fim, na terceira seção, examinam-se as intersecções da tecnologia com a sistemática da tributação indireta, por meio do estudo da governança e da prestação de serviços públicos via blockchain, da aplicabilidade do registro distribuído no âmbito tributário e das possibilidades de codificação da lei tributária. Encerra-se o tópico com a avaliação, sob parâmetros tecnológicos, da Lei Complementar n.º 175/2020, que introduziu modificações no regime do Imposto sobre Serviços de Qualquer Natureza. Conclui-se que o país vive um ambiente tributário de insegurança jurídica, extremamente confuso e nocivo para o contribuinte. O cenário estudado denota opacidade fiscal, agravada pelos instrumentos de ilusão, ofuscamento e anestesia aplicados ao sistema tributário nacional. A opacidade produz efeito negativo em cadeia na efetividade das garantias constitucionais tributárias, diante do amplo desconhecimento a respeito das questões objetivas envolvendo a tributação. A partir da das características de descentralização e transparência da tecnologia de registro distribuído e das ideias de ¿lei como código¿ e ¿regras como código¿, propõe-se a adoção da ¿tributação inteligente¿, com administração tributária distribuída, registro distribuído das transações e codificação das leis tributárias em blockchain.

This master¿s dissertation, related to the field of law and technology, is set to understand the distributed ledger technology (DLT) and its applications such as blockchain and smart contracts in the context of indirect taxation in Brazil. It seeks to answer how distributed ledger technology fits into the indirect taxation system in Brazil. In chapter one, it analyzes the characteristics of indirect taxation and its influence on the country's fiscal environment. In chapter two, it delves into the distributed ledger technology and its applications such as blockchain and smart contracts. In chapter three, it explores the legal scenarios, benefits, and risks of applying the technology in the context of indirect taxation. It can be considered applied research since it proposes a technological alternative to the intended legislative and constitutional tax reforms. Therefore, in the first chapter, a descriptive and critical study is carried out on Brazilian indirect taxation, addressing issues peculiar to the political organization of the country, characteristics of indirect taxes, their role in government revenue and some of the aspects that make them overly complex. In the next chapter, it discusses the DLT technological framework, the nature of this technology and its best-known applications, as well as the notion of ¿law is code,¿ which represents the transposition of legal rules into code-based rules. Finally, in chapter three, the intersection between the technology and the indirect taxation system is examined, through the study of governance and the provision of public services via blockchain, the applicability of distributed ledgers in the tax environment and the possibilities of coding the tax law. It ends with an assessment, under technological parameters, of Complementary Law No. 175/2020, which introduced changes to the municipal services tax regime. The conclusion is that the country is experiencing a tax environment of legal uncertainty, extremely confusing and harmful to the taxpayer. The studied scenario denotes fiscal opacity, aggravated by the instruments of illusion, obfuscation and anesthesia applied to the national tax system. Opacity has a negative chain effect on the effectiveness of constitutional guarantees regarding taxation, given the widespread lack of knowledge about objective issues involving taxation. Based on the characteristics of decentralization and transparency of the distributed ledger technology and the ideas of "law is code" and "rules as code," it proposes the adoption of "smart taxation," with distributed tax administration, distributed transaction records and ¿code-ification¿ of tax laws.
