O objetivo geral do presente trabalho é estabelecer uma relação entre os fundamentos do Novo Constitucionalismo Latino-Americano e a gestão das águas subterrâneas transfronteiriças. Busca-se estudar como o giro ecocêntrico e o reconhecimento dos direitos da Natureza, oriundos daquele movimento constitucional, podem implicar a construção de instrumentos normativos e a elaboração de diretrizes à construção de políticas públicas voltadas à gestão das águas subterrâneas transfronteiriças. Nos estudos sobre o processo de integração na América Latina, procura-se identificar um modelo de instância internacional capaz de viabilizar a discussão proposta e constata-se a estrutura da UNASUL como a mais adequada, dado o seu processo de formação e objetivos traçados. Justifica-se a pesquisa em razão da grave crise civilizatória pela qual a humanidade atravessa e a insuficiência do modelo epistêmico hegemônico que forjou a ciência jurídica à luz de uma matriz antropocêntrica. Em razão da pouca visibilidade das águas subterrâneas transfronteiriças, da existência de mananciais significativos na América Latina e da relevância para o ecossistema, volta-se o olhar para o tema. A abordagem da pesquisa é qualitativa quanto ao tipo, pois não visa à análise do objeto a partir da elaboração de dados estatísticos, mas sim de sua caracterização quanto à historicidade e normatividade. Nesse sentido, tem natureza exploratória, mas também descritiva e crítica dos documentos normativos e das posições doutrinárias. Opta-se pelo método de abordagem dialético utilizando-se procedimento comparativo e as técnicas de pesquisa bibliográfica com ampla análise documental.

The general objective of this work is to establish a relationship between the foundations of the New Latin American Constitutionalism and the management of transboundary groundwater. It seeks to study how the ecocentric shift and the recognition of the rights of Nature, originating from that constitutional movement, may imply the construction of normative instruments and the elaboration of guidelines for the construction of public policies aimed at the management of transboundary groundwater. In the studies on the integration process in Latin America, an attempt is made to identify a model of international instance capable of making the proposed discussion viable, and the structure of UNASUL is verified as the most appropriate, given its formation process and objectives outlined. The research is justified due to the serious civilizatory crisis that humanity is going through and the insufficiency of the hegemonic epistemic model that forged legal science in the light of an anthropocentric matrix. Due to the low visibility of transboundary groundwater, the existence of significant springs in Latin America, and the relevance to the ecosystem, we turn our gaze to the subject. The approach of the research is qualitative as to type, since it does not aim at the analysis of the object from the elaboration of statistical data, but rather its characterization as to historicity and normativity. In this sense, it has an exploratory nature, but also descriptive and critical of normative documents and doctrinal positions. The dialectical approach method is chosen, using a comparative procedure and bibliographical research techniques with extensive documental analysis.
