O estudo analisou os efeitos da justiça distributiva como instrumento de investimento social, inspirado no modelo de Estado de bem-estar da Agenda de Lisboa 2000, com foco nos direitos do contribuinte idoso perante à obrigatoriedade de tributação do Imposto de Renda da Pessoa Física ¿ IRPF. Atrelou-se aos âmbitos constitucional, jurídico e tributário. Fundamentou-se na situação concreta dos direitos sociais dos idosos e no exercício de sua dupla função de provedor de recursos de subsistência pessoal e familiar na realidade contemporânea. Nesse cenário de envelhecimento, o aumento da estimativa de vida também influencia o aumento de gastos, deteriora os recursos financeiros do contribuinte idoso e de sua família, inclusive em situações de riscos sociais que atingem a população e também as políticas sociais que assistem os grupos vulneráveis. Destaca-se como questão a discrepância tributária em consonância com os direitos sociais dos idosos. Dessa forma, estabeleceu-se o cotejo para identificar se normas do IRPF na situação dos idosos estão em conformidade com o proposto na Constituição brasileira de 1988 e no Estatuto do idoso. O objetivo geral buscou analisar as implicações decorrentes das exigências normativas do IRPF, no período de 2007 a 2017, em consonância com a garantia do direito de bem-estar do grupo de idosos. Os objetivos específicos buscaram: a) identificar o índice de contribuição tributária dos idosos e o consequente impacto nos níveis de bem-estar pessoal e familiar; b) investigar se o índice em forma de desconto tributário nas especificidades exigidas pelo IRPF estão em consonância com as normas constitucionais; c) identificar se a isenção tributária constitui possibilidade concreta de investimento para garantia de bem-estar do idoso e família; e d) mensurar se a isenção tributária ocasionará prejuízo significativo para o total arrecadado pelo tesouro nacional. Foram elaboradas tendências simuladas para isenção tributária que revelaram possibilidades concretas para garantia de um melhor bem-estar dessa faixa etária como um esforço de justiça distributiva. A metodologia foi bibliográfica, documental, interpretativa, quantitativa, qualitativa, analítica e empírica. Teve-se como resultado a comprovação de que é possível uma justiça distributiva como instrumento de investimento social e bem-estar do idoso ao se atribuir uma possível isenção na sua carga tributária, com alteração no disposto na norma do IRPF, em concretude à dignidade do idoso e o correspondente reconhecimento legal. O resultado ensejou a garantia da cidadania e consequentes medidas regulatórias de maior proteção social. O estudo buscou uma reflexão jurídico-constitucional e a obtenção de insumos no espaço constitucional da realidade brasileira, e desta feita propõe soluções para a problemática em pauta.

The study analyzed the effects of distributive justice as an instrument of social investment, inspired by the welfare state model of the Lisbon Agenda 2000, focusing on the rights of the elderly taxpayer regarding the obligation to tax the Individual Income Tax - IRPF. It was linked to the constitutional, legal and tax scopes. It was based on the concrete situation of the social rights of the elderly and the exercise of their dual role as provider of personal and family livelihood resources in contemporary reality. In this aging scenario, the increase in life estimates also influences the increase in spending, deteriorates the financial resources of the elderly taxpayer and his family, including in social risk situations that affect the population and also the social policies that assist vulnerable groups. The issue is the tax discrepancy in line with the social rights of the elderly. This way, the comparison was established to identify if IRPF norms in the situation of the elderly are in accordance with the proposed in the Brazilian Constitution of 1988 and in the Elderly Statute. The overall objective was to analyze the implications arising from the IRPF normative requirements, from 2007 to 2017, in line with the guarantee of the right of welfare of the elderly group. The specific objectives sought to: a) identify the tax contribution rate of the elderly and the consequent impact on personal and family welfare levels; b) investigate whether the index in the form of tax rebate on the specificities required by the IRPF are in line with constitutional norms; c) identify if the tax exemption constitutes a concrete investment possibility to guarantee the welfare of the elderly and their families; and d) measure whether the tax exemption will cause significant loss to the total collected by the national treasury. Simulated trends for tax exemption were developed that revealed concrete possibilities to guarantee a better welfare of this age group as a distributive justice effort. The methodology was bibliographic, documentary, interpretative, quantitative, qualitative, analytical and empirical. The result was the proof that distributive justice is possible as an instrument of social investment and welfare of the elderly by attributing a possible exemption in their tax burden, with changes in the provisions of the IRPF norm, concretely to the dignity of the elderly and the corresponding legal recognition. The result was the guarantee of citizenship and consequent regulatory measures for greater social protection. The study sought a legal-constitutional reflection and obtaining inputs in the constitutional space of the Brazilian reality, and this time proposes solutions to the problem at hand.
