Resumo Esta dissertação tem por escopo levantar e analisar os argumentos sociojurídicos que envolvem a temática do reconhecimento estatal sobre o direito à identidade pessoal em conformação com o gênero, a partir da compreensão sobre o que se entende por direitos fundamentais e o papel da dignidade humana... Ver mais Esta dissertação tem por escopo levantar e analisar os argumentos sociojurídicos que envolvem a temática do reconhecimento estatal sobre o direito à identidade pessoal em conformação com o gênero, a partir da compreensão sobre o que se entende por direitos fundamentais e o papel da dignidade humana na construção deste direito. Este direito é reclamado pelas pessoas que compõem o grupo Trans, ou seja, pessoas cuja identidade de gênero não corresponde àquela imposta no nascimento, e, por isso, precisam de reconhecimento da sociedade e do Estado sobre a nova identidade autopercebida. Analisa-se especialmente o reconhecimento estatal sobre o direito à identificação civil conforme o gênero do indivíduo, nos moldes delineados no julgamento da Ação Direta de Inconstitucionalidade nº 4.275/DF, pelo Supremo Tribunal Federal, em cotejo com as discussões teóricas da melhor doutrina nacional e internacional sobre direitos fundamentais e teoria política, e, ainda, à luz da Constituição Federal de 1988, do Código Civil de 2002, da Lei de Registros Públicos (Lei nº 6.015, de 31 de dezembro de 1973), bem como orientações contidas em Pactos Internacionais firmados pelo Brasil consoantes à matéria objeto deste estudo. A importância desta pesquisa revela-se pela tese jurídica contida na decisão final da Suprema Corte do país sobre a ADI nº 4.275/DF, revelada pela autorização aos transgêneros para solicitarem a modificação do registro civil sem necessidade de ordem judicial, considerando a autodeclaração de gênero, com fundamento principal na dignidade da pessoa humana. Trata-se de investigação bibliográfica e documental, por meio de abordagem qualitativa, com caráter exploratório, do tipo estudo de caso. Resulta deste trabalho científico informações sobre os aspectos legais e constitucionais que devem nortear o reconhecimento estatal sobre do direito de ser civilmente identificado considerando o gênero autodeterminado pelo indivíduo.

Ver mais This dissertation aims to analyze and analyze the socio-juridical arguments that involve the theme of state recognition of the right to personal identity in conformity with gender, based on the understanding of what is meant by fundamental rights and the role of human dignity in the construction this right. This right is claimed by the people who make up the Trans group, that is, people whose gender identity no longer corresponds to that imposed at birth, and therefore need recognition from society and the state about the new self-perceived identity. The State's recognition of the right to civil identification according to the gender of the individual, in the manner outlined in the judgment of the Direct Action of Unconstitutionality No. 4,275 / DF, by the Federal Supreme Court, in comparison with the theoretical discussions of the best national doctrine, is analyzed. international law on fundamental rights and political theory, and also in light of the 1988 Federal Constitution, the Civil Code of 2002, the Public Registers Law (Law No. 6,015, dated December 31, 1973), as well as guidelines contained in Pactos International agreements signed by Brazil according to the subject matter of this study. The importance of this research is revealed by the legal theory contained in the final decision of the Supreme Court of the country on ADI No. 4,275 / DF, revealed by the authorization to transgenders to request the modification of the civil registry without need of a court order, considering the self-declaration of gender , with fundamental basis in the dignity of the human person. It is a bibliographical and documentary research, through a qualitative, exploratory, case-study approach. It results from this scientific work information on the legal and constitutional aspects that should guide the state recognition of the right to be civilly identified considering the gender.
