O trabalho analisa as relações entre Estado e Economia, avançando desde as concepções do liberalismo e do intervencionismo até chegar ao moderno conceito de Estado-regulador e às atuais correntes teóricas sobre a regulação econômica, adotando uma metodologia interdisciplinar, por meio da qual as questões jurídicas são associadas com aspectos e instrumentos da Economia. Trata de 2 (dois) aspectos inerentes à atuação dos reguladores e das agências reguladoras ¿ a legitimidade e os limites de atuação ¿ a partir de uma nova visão de sociedade, em que se observa uma evolução de conhecimentos técnicos e científicos nos mais diversos setores, conduzida por um notável processo de desenvolvimento tecnológico. A rapidez vivida pela atual sociedade tem exigido uma reformulação no papel do legislador tradicional, uma releitura da clássica separação de poderes e do princípio da legalidade. É a partir desse acelerado ritmo de mudanças sociais e econômicas que a tese elabora 4 (quatro) proposições básicas: 1) a função normativa dos reguladores é decorrência de uma nova interpretação a ser conferida à Teoria da Separação de Poderes, com a finalidade de adequá-la à evolução da sociedade e do Direito nos dias atuais, em que se apresentam transformações que exigem um novo modelo de normatização das relações sociais e econômicas, ou seja, um nova forma de intervenção estatal; 2) é necessária uma releitura do fundamento de legitimidade do poder normativo dos reguladores, que passa a ser definido por uma forma particular de discricionariedade administrativa ¿ a discricionariedade técnica ¿, a guiar a atuação dos reguladores sobre os agentes econômicos regulados; 3) a regulação atual está diante de um crescimento de seu escopo e profundidade, a exigir que reguladores avancem sobre assuntos tradicionais, como os monopólios, os bens comuns, as externalidades econômicas (positivas e negativas) e as políticas públicas distributivas, e se ocupem agora de temas como controle da corrupção e integridade dos agentes econômicos; 4) é preciso delinear os limites da chamada ¿nova economia¿, ou seja, o conjunto de princípios e diretrizes que os reguladores devem desempenhar ou adotar diante das novas tecnologias, de um fenômeno marcante das novas relações sociais, o consumo colaborativo ¿ que tem potencial para alterar a face tradicional do capitalismo, com sua prevalência do uso sobre a posse ¿; nesse novo cenário econômico, o trabalho também leva em conta a economia comportamental como instrumento de apoio aos reguladores. As conclusões finais extraídas da pesquisa realizada podem ser resumidas em 2 (duas) preposições básicas. Em primeiro lugar, a nova legalidade dos agentes reguladores é representada pela discricionariedade técnica, capaz de acompanhar a rápida evolução da sociedade e dos agentes econômicos e sendo complementar ao papel do legislador ordinário. Em segundo lugar, a atual sociedade exige que o regulador reexamine a ordem econômica, tanto para entender novas necessidades da regulação estatal tradicional quanto para esboçar os preceitos básicos regentes da nova economia, representada pelas inovações tecnológicas, pelo consumo colaborativo e pela economia comportamental.

The paper analyzes the relations between the State and the Economy, moving from the conceptions of liberalism and interventionism to the modern concept of the State-regulator and the current theories on economic regulation, adopting an interdisciplinary methodology, where legal issues are associated with aspects and instruments of the Economy. It deals with two aspects inherent to the activities of regulators and regulatory agencies - the legitimacy and limits of action - from a new vision of society, where there is an evolution of technical and scientific knowledge in the most diverse sectors, conducted by a remarkable process of technological development. The rapidity experienced by the present society has required a reformulation in the role of the traditional legislator, a re-reading of the classic separation of powers and the principle of legality. It is from this accelerated pace of social and economic changes that the thesis elaborates 4 (four) basic propositions: 1) the normative function of the regulators is due to a new interpretation to be conferred to the Theory of Separation of Powers, with the purpose of adequacy to the evolution of society and law in the present day, in which are presented transformations that require a new model of normalization of social and economic relations, that is, a new form of state intervention; 2) there is a need to re-examine the legitimacy foundation of regulatory power, which is defined by a particular form of administrative discretion - technical discretion - to guide regulators' performance over regulated economic agents; 3) current regulation is facing a growth of its scope and depth, requiring regulators to advance on traditional issues such as monopolies, commons, economic externalities (positive and negative) and distributive public policies, and now such as corruption control and the integrity of economic agents; 4) it is necessary to delineate the limits of the so-called "new economy", that is, the set of principles and guidelines that regulators must play or adopt in the face of new technologies, a marked phenomenon of new social relations, collaborative consumption potential to alter the traditional face of capitalism, with its prevalence of use over possession -; in this new economic scenario, work also takes into account behavioral economics as a tool to support regulators. The final conclusions drawn from the research can be summarized in 2 (two) basic prepositions. Firstly, the new legality of regulators is represented by technical discretion, able to accompany the rapid evolution of society and economic agents and is complementary to the role of the ordinary legislator. Second, current society requires the regulator to reexamine the economic order, both to understand new needs for traditional state regulation and to outline the basic precepts of the new economy, represented by technological innovations, collaborative consumption, and behavioral economics.
