O Tribunal Superior Eleitoral detém competência para expedir instruções que viabilizem a fiel aplicação da legislação eleitoral, em caráter secundário, sem restringir direitos ou estabelecer sanções diversas das previstas em lei. A dissertação discute esse poder normativo e identifica resoluções que violaram o Texto Constitucional ou transbordaram os claros limites impostos pela lei. Daí a necessidade de delinear as vias de controle de constitucionalidade e de legalidade disponíveis perante o Poder Judiciário e o Poder Legislativo. Os resultados foram obtidos por intermédio de estudo bibliográfico, com pesquisa do tipo qualitativa e análise exploratória/crítica, além de exame documental de textos normativos e decisões judiciais. Para se chegar à conclusão, a pesquisa expressa o modo como se deu o exercício da cidadania política no Brasil até a criação da Justiça Eleitoral, em 1932, importante marco para consolidação da democracia, e como esta se encontra organizada. Em seguida, disserta-se sobre o poder normativo do TSE, seus fundamentos, natureza jurídica, classificação e os limites que deveriam efetivamente ser observados por suas resoluções. Há grande controvérsia teórica sobre a própria constitucionalidade do poder normativo do TSE, considerando que ele não guarda fundamento de validade na Constituição, mas se concluiu ser ele constitucional, desde que não se apresente de modo autônomo da legislação. Adiante, confronta-se esse poder normativo com a técnica de separação de poderes e os princípios da legalidade e reserva legal, com o desiderato de demonstrar a importância do cumprimento destes na contextura do Estado Democrático de Direito. Considerando o fato de que os atos normativos secundários necessariamente possuem limites imanentes, a dissertação passa à exposição das técnicas de controle de constitucionalidade e de legalidade adotadas no Brasil e como têm sido de fato utilizadas para impugnar resoluções do Tribunal Superior Eleitoral, sobretudo com suporte na interpretação conferida pelo Supremo Tribunal Federal nas decisões que proferiu sobre o tema. A investigação conclui que há claramente um self restraint da jurisdição quando da análise da constitucionalidade das resoluções, seja pelo controle difuso, seja pelo abstrato, além do fato de ter se tolhido equivocadamente a possibilidade de seu controle repressivo pelo Parlamento, mediante decreto legislativo.

The Superior Electoral Court has the function of issuing instructions that enable the effective application of electoral legislation, on a secondary basis, without restricting rights or establishing sanctions different from those provided by law. The dissertation discusses this normative function and identifies resolutions that violated the constitution or exceeded the clear limits imposed by the law, hence the need to delineate the ways of controlling constitutionality and legality available to the Judiciary and the Legislative Branches. The results were obtained through a bibliographic study, with qualitative research and exploratory/critical analysis, as well as documentary examination of normative texts and judicial decisions. In order to reach the conclusion, the research presents how the exercise of political citizenship in Brazil until the creation of the Electoral Justice in 1932, an important landmark for the consolidation of democracy, and how it is organized. Then, it is discussed the normative function of the TSE, its fundamentals, legal nature, classification and the limits that should be effectively observed by its resolutions. There is great theoretical controversy about the very constitutionality of the normative function of the TSE, considering that it has no basis of validity in the constitution, but ended up being concluded constitutional, as long as it does not act independently (autonomously) from the legislation. Later, this normative power is confronted with the technique of separation of powers and the principles of legality and legal reserve, with the aim of demonstrating the importance of their fulfillment in the Democratic State of Law. Considering the fact that secondary normative acts necessarily have immanent limits, the dissertation becomes the exposition of the techniques of judicial review and legality adopted in Brazil and how they have in fact been used to challenge decisions of the Superior Electoral Court, especially since interpretation given by the Federal Supreme Court in its decisions on the subject. The investigation concludes that there is clearly a self restraint of jurisdiction when analyzing the constitutionality of resolutions, whether by diffuse or abstract control, in addition to the fact that the possibility of their repressive control by Parliament was erred by legislative decree.
