Esta dissertação visa a apresentar estudo sobre a magistratura cearense, tema ainda com pesquisas escassas, sobretudo quando se objetiva compreender esta classe dentro do contexto do regime militar, instaurado no Brasil, em 1964. Este período autoritário acarreta experiências de repressão e, consequentemente, abre espaço para a ocorrência de resistência às intervenções do Estado ditador. Importa, portanto, analisar se os magistrados cearenses sofreram repressão durante a ditadura militar brasileira e se eles resistiram às interferências do Executivo militar. O estudo inicia com a comparação das experiências vividas pelo Judiciário em outros regimes antidemocráticos, sendo: na Itália fascista, em Portugal salazarista e na Alemanha nazista. Posteriormente, examinam-se quais foram os períodos autoritários da história republicana brasileira e qual a repercussão destas fases sobre o Poder Judiciário e sobre as Forças Armadas. A análise recai sobre os magistrados, os militares e a política no Brasil republicano. Verifica-se que aposentadorias compulsórias, que é um tipo de repressão, já eram realizadas nos magistrados pela Era Vargas. Outrossim, os militares, sob a fundamentação de restabelecer a ordem, eram requisitados habitualmente para desalojar o Executivo e transferir o poder político para os civis conspiradores da deposição. Em um terceiro momento, explora-se o contexto histórico e jurídico do período autoritário brasileiro, compreendido de 1964 a 1985, no qual os militares não se contentaram com a legitimidade para apenas intervir: a legitimidade seria também para governar. A ideologia da Doutrina de Segurança Nacional, adotada pela ditadura militar é apontada, bem como os aspectos da recepção do golpe militar pelo Supremo Tribunal Federal. A normatização excepcional destaca a Constituição de 1967 e os Atos Institucionais nº 1, nº 2, nº 5 e nº 6, registrando as consequências desses dispositivos no Judiciário. As adoções de medidas reparadoras dos danos provocados pelo regime autoritário na passagem deste para o regime democrático também foram estudadas. Por fim, apontam-se casos de repressão e de resistência ocorridos em outros estados brasileiros, antes de relatar a metodologia e os desafios da pesquisa empírica realizada no Tribunal de Justiça do Estado do Ceará ? TJ/CE, a qual revelou três casos de repressão a magistrados cearenses, sendo dois casos de aposentadorias compulsórias e um caso de disponibilidade, bem como foram utilizadas as medidas repressoras de intervenção às salas de audiências e de controle dos documentos e dados do TJ/CE. Contra a opressão, a pesquisa identificou, em alguns discursos proferidos nas posses presidenciais do Tribunal, a resistência dos juízes cearenses.Palavras-chave: Regime militar. Judiciário. Military regime and the Judiciary: repression and resistance in the Ceará state legal system aims to present study on the Ceará judiciary, theme still scarce research, especially when it aims to understand this class within the context of the military regime, introduced in Brazil, in 1964. This entails authoritarian period of repression experiences and consequently opens space for the development of resistance to the interventions of the dictator state. It is therefore necessary to consider whether the Ceará magistrates suffered repression during the Brazilian military dictatorship and if they resisted the interference of the military executive. The study begins with a comparison of the experiences of the judiciary in other undemocratic regimes, as follows: in Fascist Italy, Salazar in Portugal and in Nazi Germany. Subsequently, it examines what were the authoritarian periods in Brazilian republican history and what the impact of these steps on the judiciary and on the military. In other words, the analysis lies with the judiciary, the military and politics in Republican Brazil. It appears that compulsory retirement, which is a type of repression, were already held in the magistrates by Vargas. Moreover, the military, under the rationale of restoring order, were usually required to dislodge the Executive and transfer political power to the conspirators civil deposition. In a third step, it explores the historical and legal context of the Brazilian authoritarian period running from 1964 to 1985, in which the military were not content with the legitimacy to intervene only: legitimacy would also be to govern. The ideology of the National Security Doctrine, adopted by the military dictatorship is pointed as well as aspects of reception of the military coup by the Supreme Court. The exceptional regulation highlights the 1967 Constitution and the Acts Institutional nº 1, nº 2 , nº 5 and nº 6, recording the consequences of these devices in the judiciary. The adoption of remedial measures for damage caused by the passage of this authoritarian regime to democracy were also studied. Finally, they point up cases of repression and resistance that occurred in other Brazilian states, before reporting methodology and the challenges of empirical research conducted in the State of Ceará Court - TJ/CE, which revealed three cases of repression the Ceará magistrates, two cases of compulsory retirement and a case of availability as well as they used the repressive measures of intervention of courtrooms and control of documents and data from TJ/CE. Against oppression, the survey identified in some speeches in presidential possessions of the Court, the resistance of Ceará judges.
