A presente dissertação tem por objeto o ativismo judicial. O principal objetivo é identificar se o mesmo age como uma ferramenta de controle preventivo do processo legislativo, influenciando de forma direta ou indireta na elaboração das leis, sejam elas constitucionais ou infraconstitucionais. A hipótese levantada pela pesquisa é afirmativa e foi confirmada com o seu desenvolvimento. O trabalho tem um caráter empírico exploratório que utiliza a técnica da pesquisa documental, bibliográfica e jurisprudencial para investigar a temática da forma mais abrangente possível, possibilitando uma contribuição para novas pesquisas que devem ser cotidianamente realizadas. O referencial teórico utilizado tenta apresentar as diversas visões de autores nacionais e estrangeiros chegando a uma conclusão analítica e crítica sobre o mesmo. Não obstante, apesar de demonstrar a visão democrática da teoria ativista, apresenta também um enfoque nos autores que justificam o posicionamento contrário. Em suma, é destacado o fato de que o Estado democrático e pluralista de direito brasileiro admite, em doses homeopáticas, o uso da teoria ativista, porém, nos últimos anos nota-se que essa aplicação tem se intensificando. O Poder Judiciário tem importante papel para responder aos anseios da sociedade, observando o dimensionamento estabelecido pelo Poder Legislativo, e sua atuação, quando adequada, não pode ser considerada ativista, porém, ultrapassando esse limite adentra em um campo nebuloso onde os limites não são bem definidos. Os limites existem, estão na Constituição - que, nos Estados democráticos, é um instrumento de autolimitação popular, pois, entre todos os valores sociais, elegem-sequais são os que formam a estrutura fundante -, nas legislações e nas formações espontâneas dos grupos sociais. Doravante, o ativismo judicial pode revelar seu sentido, conectado a conceitos e valores estabelecidos pela Constituição e pelas leis infraconstitucionais e regimentos, sem causar prejuízos aos indivíduos e à sociedade como um todo.

This thesis is engaged in judicial activism. The main objective is to identify whether it acts as a preventive tool of control of the legislative process, influencing directly or indirectly in making laws, whether constitutional or infra. The hypothesis raised by the survey is affirmative and was confirmed with its development. The work has an exploratory empirical character that uses the technique of documentary research, literature and case law to investigate the issue as widely as possible, enabling a contribution to new research to be carried out daily. The theoretical framework tries to present different views of domestic and foreign authors coming to a conclusion analytical and critical about the same. However, in spite of demonstrating the democratic vision of activist theory also has a focus on authors to justify the opposite position. In short, it highlighted the fact that the democratic and pluralistic State of Brazilian law allows, in homeopathic doses, the use of activist theory, but recent years we note that this application is intensifying. The judiciary has an important role to respond to the needs of society, observing the design established by the Legislature, and its performance, when appropriate, can not be considered activist, however, exceeding this limit enters on a cloudy field where the limits are not well defined. The limits exist, are in the Constitution - that in democratic states, is a popular voluntary restraint instrument because, among all social values, are elected who are hey that form the foundational structure - in legislation and in the spontaneous formation of groups social. From now on, judicial activism can reveal its meaning, connected to concepts and values established by the Constitution and the infra laws and regulations, without causing damage to individuals and society as a whole.
