A filosofia e a ciência política procuram compreender o poder e, nesta busca, tentam estabelecer suas características. Não há consenso em relação a estas, mas existem alguns temas constantes quanto ao assunto. A partir deste temário regular sobre o poder foram estabelecidas duas formas básicas de organização política. Na primeira a soberania popular tem função destacada, enquanto na segunda a representação política alcança maior importância. Dentre os pensadores políticos clássicos Rousseau adotou o povo como soberano e, inspirado no direito romano, concebeu uma instituição política, separada dos poderes tradicionais, que seria responsável pelo equilíbrio social e político. Montesquieu, por sua vez, teorizou a respeito da Constituição inglesa, apostando na representação e na possibilidade do equilíbrio político ser promovido dentro da relação existente entre os poderes tradicionais. Na América Latina as lições provenientes do direito romano inspiraram o surgimento do Defensor do Povo dotado da atribuição de equilíbrio social mediante a proteção dos direitos humanos. A organização política brasileira apresenta elementos conciliáveis com o pensamento dos dois teóricos clássicos precitados, mas apenas a teoria do poder de Rousseau permite compreender as funções essenciais à justiça previstas na atual Constituição do Brasil. A cultura jurídica brasileira, entretanto, possui forte influência das lições de Montesquieu, razão pela qual o equilíbrio social e institucional vem sendo compreendido apenas através da atuação dos três poderes tradicionais. Desta forma, as funções essenciais à justiça são mal interpretadas, percebidas de forma isolada e até mesmo contraditória. Muito pouco se comenta a respeito da atribuiçãode moderação que as mesmas devem desempenhar. Talvez em razão dos questionamentos feitos quando foi adotado o poder moderador no Brasil se tenha olvidado que este poder faz-se presente em toda organização política, não sendo diferente na realidade brasileira, onde a moderação reside nos freios e contrapesos típicos da separação dos poderes, no controle de constitucionalidade e também nas funções essenciais à justiça.

The Philosophy and the Political Science aim to understand the power and, during this search, try to identify its characteristics. Despite there isn?t consensus on the characteristics, there are some constant themes in the subject. From these regular themes about the power, two basic forms of political organization were established. In the first form, the popular sovereignty has fundamental consideration, while in the second one the political representation achieves greater significance. Among the classical political philosophers, Rousseau took the people as sovereign and, inspired by Roman law, conceived a political institution, apart from the traditional powers, which should be responsible for social and political balance. On the other hand, Montesquieu wrote about the English Constitution, advocating the representation and the possibility of being promoted political balance within the relationship betweenthe traditional powers. In Latin America the ideas derived from Roman law inspired the emergence of the People Defender which is provided by the attribution of social balance through human rights protection. The Brazilian political organization presents elements compatible with the theory of the two thinkers previously named, but only the rousseaunian power theory enables us to comprehend the essential functions to justice included in current Brazilian Constitution. The Brazilian juridical culture, however, accepts a strong influence from Montesquieu?s ideas, therefore the social and institutional balance has only been comprehended through the performance of the three traditional powers. Consequently, the essential functions to justice are misunderstood, perceived in isolation and even contradictory. Very little is said about the attribution of moderation that they should interpret. Perhaps because the questions raised when it was adopted the Moderator Power in Brazil has forgotten that this function exists in every political organization, not being different in the Brazilian context, where moderation resides in the checks and balances typical of separation powers doctrine, in the constitutional review and also in the essential functions to justice.
